AGREEMENT TO OUR SALES TERMS

 

These Terms of Sale ("Agreement") govern the purchase of products ("Products") from HANI MOKHTA STUDIO SDN BHD (“Company”,"Seller," "we," "us," or "our"). We operate the website www.hanimokhta.com (the ‘Site’) (collectively, the ‘Services’), as well as any other related products and services that refer or link to these legal terms (the ‘Sales Terms’). By placing an order for any of our Products, you ("Customer," "you," or "your") agree to these terms. 


These Sales Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (‘you’,’your’ or ‘buyer’) and Hani Mokhta Studio Sdn Bhd, concerning your access to and use of the Services. You agree that by accessing the Services and purchasing a product, you have read, understood and agreed to be bound by all of these legal terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE OR PURCHASE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Sales  Terms from time to time. We will not alert you about any changes of the terms. It is your responsibility to review these Sales Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted the changes in any revised Sales Terms by your continued use of the Services at any point in time.


  1. OUR SERVICES


The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any requirement within such jurisdiction or country. Accordingly those who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws and regulations, if and to the extent local laws are applicable.


  1. INTELLECTUAL PROPERTY RIGHTS


Our intellectual property

We are the owner of the licensee of all intellectual property rights in our Services, including all source code, functionality, audio, video, text, photographs and graphics in the Services (collectively, the ‘Content’) as well as the trademarks, service marks, logos contained therein (the ‘Marks’).


The Content or Marks are provided in or through the Services ‘AS IS’ for your personal, non-commercial use only. 


Your use of our Services 

Subject to your compliance with these Legal Terms, including the ‘PROHIBITED ACTIVITIES’ section below, we grant you a non-exclusive, non transferable revocable licence to 

  • Access the Services; and

  • Download, print a copy of any portion of the Content to which you have properly gained access.


  Solely for your personal, non-commercial use.


Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.


  1. PRODUCT INFORMATION

We strive to ensure that all product descriptions, images, and specifications on www.hanimokhta.com are accurate and up-to-date. However, we do not guarantee the accuracy, completeness, or reliability of any product information, including but not limited to prices, availability, and product features. The product details, images, and specifications may vary slightly from the actual product, and we reserve the right to correct any errors or omissions at any time.


  1. PRODUCT AVAILABILITY

All products listed on our website are subject to availability. In rare cases, a product may be temporarily out of stock or unavailable for purchase. If we are unable to fulfill your order due to unavailability, we will notify you via email or through your account page, and you may either choose to wait for restocking, select an alternative product, or request a cash refund.

 

  1. PRICING INFORMATION

All prices listed on our website are in (MYR, RINGGIT MALAYSIA) and are subject to change without notice. While we make every effort to ensure that the pricing information is accurate, mistakes can occur. If a product’s price is found to be incorrect, we will notify you as soon as possible, and you will have the option to cancel or proceed with the order at the correct price.

  • Shipping Costs: Shipping charges will be calculated at checkout and are not included in the product price unless explicitly stated.

  • Domestic Shipping Costs : Shipping charges will be calculated at checkout for sale or reduced priced items. 


  1. PRODUCT VARIATIONS

Products may come in different sizes, colors, styles, or versions, which will be indicated in the product details. Please verify that the correct variation (e.g., size, color) is selected before placing your order. We do not accept returns or exchanges for incorrect variations selected by the customer.

  1. PRODUCT IMAGES & ILLUSTRATIONS

The images and illustrations displayed on the website are for reference purposes only. While we make every effort to ensure the images reflect the true nature of the product, slight variations in color or appearance may occur due to factors such as screen resolution, lighting, and photography techniques.

  1. PRODUCT USE & CARE INSTRUCTIONS

To ensure optimal performance of the product, we recommend that you follow all care and use instructions provided. Failure to follow these instructions may result in damage to the product which we will not be liable for.

  1. PRODUCT REVIEWS AND USER GENERATED CONTENT

We may provide a platform for customers to leave reviews, ratings, and comments about products they have purchased. By submitting a review or other content, you grant us the right to use your feedback for marketing, product development, or other business purposes. We do not endorse or verify the accuracy of user reviews, and we are not responsible for any opinions or claims made therein.

  1. ORDERING PROCESS 

Click on any product to view its detailed description, pricing, available sizes or colors, measurements and other relevant information. We are reachable via live chat, email, Instagram, direct phone line for any concerns prior to your purchase. 

Choose the desired options for the product (e.g., size, color, quantity).

Once you've selected your preferences, click the "Add to Cart" button. The product will be added to your shopping cart.

You can view your cart at any time by clicking on the cart icon at the top-right corner of the page.

In the shopping cart, you can review the items you’ve added, including the quantity, size, color, and price. 

You can update the quantity, remove items, or continue shopping if needed. 

Once you are satisfied with your selections, click the "Proceed to Checkout" button to begin the order finalization process.

Provide your shipping address, including name, address, city, state, postal code, and country. Ensure that all details are correct to avoid shipping delays.

Choose your preferred shipping method (e.g., standard shipping, expedited shipping) and review the associated costs.

Choose your preferred payment option (Ipay88, eGHL, GrabPay, Atome).

Review the final summary of your order, including:

  • Products purchased, quantities, and prices

  • Shipping method and cost

  • Taxes and applicable fees

  • Total order cost

We do not accept returns or exchanges for incorrect variations selected by the customer.

You must accept our Sales Terms and Conditions by checking the box provided. Ensure that you understand our policies regarding returns, cancellations, and shipping before completing your purchase.

After submitting your order, you will receive an Order Confirmation Email with the details of your purchase. This email confirms that we have received your order, but it does not yet constitute acceptance.

  1. ORDER CONFIRMATION

After you place an order, we will send you an Order Confirmation email detailing the products or services you have purchased, along with the order number, total price, and estimated shipping details. Please note that this email serves only as an acknowledgment of your order and does not constitute an acceptance of the order by us.

An order is not deemed accepted until we confirm it and dispatch the products. We reserve the right to cancel or refuse any order at our discretion, even after an order confirmation email has been sent, in cases such as inventory errors, pricing discrepancies, or other unforeseen issues. In the event of order cancellation, we will notify you promptly and issue a full refund if applicable.

  1. PAYMENT

Offering payment methods are IPAY88 Malaysia, eGHL Payment Gateway, GrabPay, Atome PayLater.

All installment payments made via Atome PayLater & GrabPay are not eligible for order returns. 

Multiple charged payments : You will need to contact your bank and retrieve transaction reference numbers and you will need to provide all necessary evidence of proof of payment on your side to sales@hanimokhta.com. Investigation will take 7 - 14 working days. 

Successful payment on your without order confirmation email is a rare occurrence but may happen due to technical errors. Kindly reach out to us at sales@hanimokhta.com

  1. SHIPPING & DELIVERY

We offer free domestic delivery via our chosen courier service at our discretion. 

All shipping timelines are specified on every single product page and shipping timelines across products may vary. During festive/holiday seasons such as Christmas, Chinese New Year, Hari Raya Aidilfitri, Hari Raya Aidiladha may cause delays longer than the specified timeline on our Site. No order cancellations or returns allowed once order has been shipped and is on transit. 

The risk of loss or damage to the products purchased from www.hanimokhta.com transfers to you, the buyer, with or without your confirmation or instructions to the delivery rider to deliver the parcel in person. This means that once you receive a call or delivery notification from the delivery rider or courier, you bear responsibility for any loss, theft, or damage to the items if and when you do not request for the parcel to be handed to you personally.

Tracking number information is provided once the item has been fulfilled. The status or movement of shipment may take 2-3 working days to reflect on the tracking page. The shipment may take some time to be picked up by courier from our warehouse if there’s a large volume of shipments especially during festive seasons.

  1. RETURNS

We accept returns in its original condition (with tags still attached, unused, unworn, unwashed, free from foreign smell and properly packaged) at your own cost within 7 days from the date the order arrived at your address. We reserve the right to reject any return or exchange request for items that do not meet these criteria.

We do not accept returns for : 

  • All orders placed via installment payment methods.

  • all sale/reduced price items.

  • All accessories (jewelry, scarves, shawls). 

Orders have to be fulfilled and delivered to begin the return process in our system. 

  • All returns will only be done in the form of STORE CREDIT with no expiration date, and will be issued to Your Store Account. 

  • We do not process or accept returns in the form of CASH / ONLINE TRANSFER / CREDIT CARD PAYMENTS.

  • Unfortunately, we are currently not accepting returns or size exchanges from Labuan (Malaysia) and ANY OTHER COUNTRIES (excluding Singapore).

  • The original shipping fee from Malaysia to Singapore will not be refunded upon returns. 

  • All returns shipping fee will be at your own cost including taxes associated with the return shipment (if any).

  • All returned must be sent to us with a tracking number notified to our team within the 7 days  from the date the order arrived at your address

  • We are not responsible for lost shipment in transit or delayed in returning to our side. No refunds will be provided if returned or exchanged shipment to our side is lost or delayed.


  1. REFUNDS

All returns will only be done in the form of STORE CREDIT with no expiration date, and will be issued to Your Store Account. 

STORE CREDIT will only be processed once the return item has safely been returned and approved. 

Cash refunds will be made only for item(s) that are unavailable upon order confirmation.

  1. EXCHANGES

We only accept size exchanges within the same design and color in its original condition (with tags still attached, unused, unworn, unwashed, free from foreign smell and properly packaged) at your own costs (including taxes if applicable) within 7 days from the date the order arrived at your address. We reserve the right to reject any exchange request for items that do not meet these criteria.  

All size exchange requests are subjected to product availability at the point of exchange. No cash refund will be provided if the requested exchange item is unavailable on our part.  

We do not accept exchanges from Labuan (Malaysia) and any other countries (except for Singapore) 

We are not responsible for damaged or lost shipment in transit or delayed in returning to our side. Your requested exchange item will only be sent once we have received the return item. No refunds will be provided if the exchanged shipment sent to our side is damaged, lost or delayed.
